Настоящий Регламент вступает в силу на двадцатый день со дня его опубликования в Официальном Журнале Европейского Союза.
Настоящий Регламент обязателен во всей своей полноте и имеет прямое действие во всех государствах-членах ЕС.

| II.1. Санитарно-гигиеническая аттестация Я, нижеподписавшийся, заявляю, что я осведомлен о соответствующих положениях Регламента (ЕС) 178/2002 Европейского Парламента и Совета ЕС от 28 января 2002 г. об установлении общих принципов и требований продовольственного законодательства, об учреждении Европейского органа по безопасности пищевых продуктов, а также об установлении процедур в отношении безопасности пищевых продуктов (ОЖ № L 31, 1.2.2002, стр. 1), Регламента (ЕС) 852/2004 Европейского Парламента и Совета ЕС от 29 апреля 2004 г. о гигиене пищевых продуктов (ОЖ № L 139, 30.4.2004, стр. 1) и Регламента (ЕС) 853/2004 Европейского Парламента и Совета ЕС от 29 апреля 2004 г. об установлении специальных правил гигиены пищевых продуктов животного происхождения (ОЖ № L 139, 30.4.2004, стр. 55) и удостоверяю, что лягушачьи лапки, описанные выше, произведены в соответствии с указанными требованиями и, в частности, что они: - поступают с предприятия(-ий), на которых осуществляется программа на основе принципов HACCP в соответствии со Статьей 5 Регламента (ЕС) 852/2004; и - получены от лягушек, которые были обескровлены, предварительно обработаны и, если это применимо, охлаждены, заморожены или переработаны, упакованы и хранились в гигиеничных условиях в соответствии с требованиями Раздела XI Приложения III к Регламенту (ЕС) 853/2004. Санитарно-гигиеническая аттестация Я, нижеподписавшийся, заявляю, что я осведомлен о соответствующих положениях Регламента (ЕС) 178/2002 Европейского Парламента и Совета ЕС от 28 января 2002 г. об установлении общих принципов и требований продовольственного законодательства, об учреждении Европейского органа по безопасности пищевых продуктов, а также об установлении процедур в отношении безопасности пищевых продуктов (ОЖ № L 31, 1.2.2002, стр. 1), Регламента (ЕС) 852/2004 Европейского Парламента и Совета ЕС от 29 апреля 2004 г. о гигиене пищевых продуктов (ОЖ № L 139, 30.4.2004, стр. 1) и Регламента (ЕС) 853/2004 Европейского Парламента и Совета ЕС от 29 апреля 2004 г. об установлении специальных правил гигиены пищевых продуктов животного происхождения (ОЖ № L 139, 30.4.2004, стр. 55) и удостоверяю, что сырье, описанное выше, соответствует указанным требованиям и, в частности, что: - <1> [кости, шкуры и кожа домашних и разводимых на ферме жвачных животных, свиней и птицы, а также сухожилия, описанные выше, получены от животных, забитых на бойне, а туши указанных животных признаны пригодными для потребления человеком, по результатам предубойной и послеубойной проверок,] и/или - <1> [шкуры диких животных, кожа и кости, описанные выше, получены от забитых животных, туши которых признаны пригодными для потребления человеком, по результатам послеубойной проверки,] и/или - <1> [кожа и кости рыб, описанные выше, получены с предприятий, производящих предназначенные для потребления человеком рыбные продукты, экспорт которых разрешен,] <1> и, если сырье животного происхождения от КРС, овец и коз, - сырье получено от животных, которые прошли предубойную и послеубойную проверки, <1> и, за исключением шкур и кож жвачных животных, <1> либо - сырье поступает из страны или региона, классифицированных в соответствии с Решением 2007/453/ЕС Европейской Комиссии от 29 июня 2007 г., устанавливающим статус государств-членов ЕС, третьих стран или их частей по отношению к риску ГЭ КРС (ОЖ № L 172, 30.6.2007, стр. 84), как страна или регион, представляющие незначительный риск ГЭ КРС, - сырье не содержит и не получено из материалов особого риска, как определено в пункте 1 Приложения V к Регламенту (ЕС) 999/2001 Европейского Парламента и Совета ЕС от 22 мая 2001 г., устанавливающего правила по профилактике, контролю и искоренению некоторых трансмиссивных губчатых энцефалопатий (ОЖ № L 147, 31.5.2001, стр. 1) [<6>, | |||

Ветеринарно-санитарная аттестация Я, нижеподписавшийся официальный ветеринар, настоящим подтверждаю, что сырье, описанное выше: II.2.1. состоит из продуктов животного происхождения, соответствующих указанным ниже ветеринарно-санитарным требованиям; II.2.2. получено с территории <1> либо [: _______ ] <1> либо [ _______ ] <2> <3> <4>, где: <1> либо II.2.2.1 животные поступают из хозяйств и находились на указанной территории с рождения или в течение как минимум последних трех месяцев перед убоем; и [<1> либо (i) виды этих животных указаны в [Регламенте (ЕС) 206/2010 Европейской Комиссии от 12 марта 2010 г., устанавливающем списки третьих стран, территорий и их частей, из которых разрешен ввоз в Европейский Союз определенных видов животных и свежего мяса, а также устанавливающем требования к ветеринарной сертификации (ОЖ № L 73, 20.3.2010, стр. 1), выполнены все соответствующие ветеринарно-санитарные требования к импорту, установленные в указанном Регламенте, а эти животные забиты с целью потребления человеком в период, когда ввоз из этой страны или с территории в Союз свежего мяса животных соответствующих видов был разрешен в соответствии со Столбцом 8 Части I Приложения II к Регламенту (ЕС) 206/2010;] | |||
| <1> либо [(ii) виды этих животных указаны в Регламенте (ЕС) 119/2009 Европейской Комиссии от 9 февраля 2009 г., устанавливающем список третьих стран и их частей для импорта в Сообщество или транзита по территории Сообщества мяса диких зайцевых, определенных видов наземных млекопитающих и разводимых на ферме кроликов, а также устанавливающем требования к ветеринарной сертификации (ОЖ № L 39, 10.2.2009, стр. 12), выполнены все соответствующие ветеринарно-санитарные требования к импорту, установленные в указанном Регламенте.]] <1> либо II.2.2.1 сельскохозяйственная птица находилась на указанной территории с рождения, либо ввезена как суточные цыплята или как сельскохозяйственная птица для убоя из третьей страны (стран), указанной в списке для такого товара в [Части 1 Приложения I к Регламенту (ЕС) 798/2008 Европейской Комиссии от 8 августа 2008 г., устанавливающему список третьих стран, территорий, зон или участков, из которых может быть разрешен импорт и транзит через Сообщество мяса птицы и продукции из мяса птицы, а также устанавливающему требования ветеринарной сертификации (ОЖ № L 226, 23.8.2008, стр. 1) в соответствии с требованиями, по крайней мере, эквивалентными тем, которые установлены этим Регламентом; состоит из видов, указанных в данном Регламенте, выполнены все соответствующие ветеринарно-санитарные требования к импорту, установленные в указанном Регламенте, а птица забита с целью потребления человеком в период, когда ввоз из этой страны или с территории в Союз мяса животных соответствующих видов был разрешен в соответствии со Столбцом 6 Части I Приложения I к Регламенту (ЕС) 798/2008.] <1> либо II.2.2.1 животные были убиты в дикой природе на указанной территории [<5>; пойманы и убиты в месте: (i) в радиусе 25 км вокруг которого не было случаев/вспышек любого из следующих заболеваний, которым подвержены животные: ящура, чумы КРС, болезни Ньюкасла, высокопатогенного птичьего гриппа — в течение предшествующих 30 дней, классической чумы свиней и африканской лихорадки — в течение предшествующих 40 дней, и (ii) на расстоянии более 20 км от границ страны или ее части, которая в данный период не имела разрешения на экспорт такого вида сырья в Европейский Союз, и (iii) откуда эти животные были транспортированы в течение 12 часов после убоя для охлаждения либо в центр сбора и незамедлительно после этого — на предприятие по обработке дичи, либо непосредственно на предприятие по обработке дичи;] II.2.3. сырье получено на предприятии, вокруг которого в радиусе 10 км не было случаев/вспышек следующих заболеваний, которым подвержены животные: ящура, чумы КРС, болезни Ньюкасла, высокопатогенного птичьего гриппа, классической чумы свиней и африканской лихорадки в течение предшествующих 30 дней, либо, если были случаи одного из указанных заболеваний, подготовка сырья для экспорта в Европейский Союз была разрешена только после уничтожения всего мяса, а также полной очистки и дезинфекции предприятия под контролем официального ветеринара; и: | |||

ПОЯСНИТЕЛЬНЫЕ ПРИМЕЧАНИЯ ПО ЗАПОЛНЕНИЮ СЕРТИФИКАТОВ
(УКАЗАННЫХ В СТАТЬЯХ 2(1) И 4(1))
(a) Сертификаты должны быть выданы экспортирующей третьей страной на основе образцов, приведенных в Приложениях II и III, согласно проекту образца для указанной продукции животного происхождения.
В той же номерной последовательности, что и в образце, сертификаты должны содержать подтверждения, которые требуются для любой третьей страны, а также в соответствующих случаях — те дополнительные гарантии, которые требуются для экспортирующей третьей страны или ее части.
Если государством-членом ЕС, являющимся страной назначения, установлены дополнительные требования к сертификации для указанной продукции животного происхождения, то в первичную форму сертификата необходимо включить подтверждение выполнения таких требований.
(b) Если в образце сертификата установлено, что определенные утверждения указываются в случае необходимости, то не относящиеся к конкретному случаю утверждения могут быть зачеркнуты и заверены подписью и печатью удостоверяющего лица либо могут быть полностью удалены из сертификата.
(c) Должен быть выдан отдельный индивидуальный сертификат для каждого вида продукции животного происхождения, которая экспортируется с территории или территорий либо зоны или зон одной и той же экспортирующей страны, включенной в список или указанной в Приложении I, и которая отправляется в один и тот же пункт назначения в одном и том же железнодорожном вагоне, грузовике, воздушном или водном судне.
(d) Оригинал каждого сертификата должен представлять собой один лист либо, если объем текста больше одного листа, все листы должны быть представлены в форме единого и неделимого документа.
(e) Сертификат должен быть составлен как минимум на одном из официальных языков государства-члена ЕС, через пункт пограничного контроля которого партия ввозится в ЕС, и государства-члена ЕС, которое является страной назначения. При этом указанные государства-члены ЕС вправе допустить составление сертификата на официальном языке другого государства-члена ЕС с приложением официального перевода при необходимости.
(f) Если для идентификации отдельных позиций в партии (перечень в пункте I.28 образца сертификата) к сертификату должны быть приложены дополнительные листы, такие листы должны рассматриваться как неотъемлемая часть оригинала сертификата путем проставления на каждой странице подписи и печати удостоверяющего лица.
(g) Если сертификат, включая дополнительные листы, указанные в пункте (f), содержит более одной страницы, внизу каждой страницы должен быть проставлен номер в формате «(номер страницы) из (общее количество страниц)», а вверху каждой страницы должен быть указан регистрационный номер сертификата, присвоенный компетентным органом.
(h) Оригинал сертификата должен быть заполнен и подписан официальным ветеринаром или иным ответственным официальным инспектором, как определено в образце сертификата. Уполномоченные органы экспортирующей третьей страны должны обеспечить выполнение правил сертификации, эквивалентных правилам, установленным в Директиве 96/93/ЕС Совета ЕС <*>.

Цвет подписи должен отличаться от цвета печатного текста. Данное требование также относится к оттискам печатей и штампов, если они не являются рельефными и не содержат водяных знаков.
(i) Регистрационный номер сертификата, указанный в графах I.2 и II.a., должен присваиваться компетентным органом.

The third countries, parts of third countries and territories from which Member States are to authorise the import of the following products of animal origin intended for human consumption are set out in the relevant Parts of Annex I:
(c) gelatine and collagen, Part III;
(d) raw materials for the production of gelatine and collagen, Part IV;
(e) treated raw materials for the production of gelatine and collagen, Part V;
(f) honey, royal jelly and other products of apiculture, Part VI;
(g) the following highly refined products, Part VII:
(iii) other hydrolysed cartilage products;
(viii) amino acids that are authorised as food additives in accordance with Regulation (EC) No 1333/2008 of the European Parliament and of the Council <*>.

1. The model certificates for imports into the Union of the products referred to in Article 1 are set out in Annex II as follows:
(e) raw materials for the production of gelatine and collagen, Part V;
(f) treated raw materials for the production of gelatine and collagen, Part VI;
(g) honey, royal jelly and other products of apiculture, Part VII;
(h) the following highly refined products, Part VIII:
(iii) other hydrolysed cartilage products;
(viii) amino acids that are authorised as food additives in accordance with Regulation (EC) No 1333/2008.
Those certificates must be completed in accordance with the explanatory notes set out in Annex IV and the notes in the relevant certificate.
2. Electronic certification and other systems agreed between the Union and the third country concerned may be used.
The third countries, parts of third countries and territories from which Member States are to authorise the transit through the Union of raw materials and treated raw materials for the production of gelatine and collagen intended for human consumption bound for a third country, either by immediate transit or after storage in the Union in accordance with Article 12(4) and Article 13 of Council Directive 97/78/EC <*>, are set out in Parts IV and V of Annex I to this Regulation, respectively.

1. The model certificate for the transit through the Union of the raw materials and treated raw materials referred to in Article 3 is set out in Annex III.
That certificate must be completed in accordance with the notes set out in Annex IV and in the relevant model certificate.
2. Electronic certification and other systems harmonised at Union level may be used.
1. By way of derogation from Article 3, transit by road or by rail between the specific, designated border inspection posts in Latvia, Lithuania and Poland, listed and marked with special remark 13 in Annex I to Commission Decision 2009/821/EC <*>, of consignments of the raw materials or treated raw materials referred to in Article 3 of this Regulation coming from and bound for Russia, directly or via another third country, shall be authorised where the following conditions are met:
<*> Commission Decision 2009/821/EC of 28 September 2009 drawing up a list of approved border inspection posts, laying down certain rules on the inspections carried out by Commission veterinary experts and laying down the veterinary units in Traces (OJ L 296, 12.11.2009, p. 1).
(a) the consignment is sealed with a serially numbered seal by the official veterinarian at the border inspection post of entry;
(b) the documents accompanying the consignment, as provided for in Article 7 of Directive 97/78/EC, are stamped with the words «Only for transit to Russia via the EU» on each page by the official veterinarian at the border inspection post of entry;
(c) the procedural requirements provided for in Article 11 of Directive 97/78/EC are complied with;
(d) the consignment is certified as acceptable for transit on the common veterinary entry document issued by the official veterinarian at the border inspection post of entry.
2. The consignments referred to in paragraph 1 shall not be unloaded or put into storage, as referred to in Article 12(4) or in Article 13 of Directive 97/78/EC, within the Union.
3. Regular audits shall be conducted by the competent authority to ensure that the number of consignments referred to in paragraph 1 and the corresponding quantities of products leaving the Union correspond with the number and quantities which have been introduced in the Union.
Annex VI to Regulation (EC) No 2074/2005 is amended as follows:
(1) in Section I, Chapters I, II, III and VI are deleted;
(2) Appendices I, II, III and VI are deleted.
Decision 2003/812/EC is repealed.
Consignments of products of animal origin in respect of which the relevant certificates have been issued in accordance with Regulation (EC) No 2074/2005 may continue to be introduced into the Union provided that the certificate was signed before 3 December 2016.
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

(a) Certificates shall be issued by the exporting third country, based on the models set out in Annexes II and III according to the layout of the model that corresponds to the products of animal origin concerned.
They shall contain, in the numbered order that appears in the model, the attestations that are required for any third country and, as the case may be, those supplementary guarantees that are required for the exporting third country or part thereof.
If the Member State of destination imposes, for the products of animal origin concerned, additional certification requirements, attestations to certify that those requirements are fulfilled shall also be incorporated in the original form of the certificate.
(b) Where the model certificate states that certain statements shall be kept as appropriate, statements which are not relevant, may be crossed out nd initialled and stamped by the certifying officer, or completely deleted from the certificate.
(c) A separate and unique certificate must be provided for the products of animal origin that are exported from a territory or territories or zone or zones of the same exporting country listed or referred to in Annex I which are consigned to the same destination and transported in the same railway wagon, lorry, aircraft or ship.
(d) The original of each certificate shall consist of a single sheet of paper, or, where more text is required it must be in such a form that all sheets of paper required are part of an integrated whole and indivisible.
(e) The certificate shall be drawn up in at least one of the official languages of the Member State of the border inspection post of entry of the consignment into the EU and of the Member State of destination. However, those Member States may authorise the certificate to be drawn up in the official language of another Member State, and accompanied, if necessary, by an official translation.
(f) If for reasons of identification of the items of the consignment (schedule in point I.28 of the model certificate), additional sheets of paper are attached to the certificate, those sheets of paper shall also be considered as forming part of the original of the certificate by the application of the signature and stamp of the certifying officer, on each of the pages.
(g) When the certificate, including additional sheets of paper referred to in (f), comprises more than one page, each page shall be numbered, (page number) of (total number of pages), at the end of the page and shall bear the certificate reference number that has been designated by the competent authority at the top of the pages.
(h) The original of the certificate must be completed and signed by an official veterinarian or by another designated official inspector where this is provided for in the model certificate. The competent authorities of the exporting third country shall ensure that rules of certification equivalent to those laid down in Council Directive 96/93/EC <*> are followed.

The colour of the signature shall be different from that of the printing. This requirement also applies to stamps other than those embossed or watermarked.
(i) The certificate reference number referred to in boxes I.2 and II.a. must be issued by the competent authority.
