JOINT PROTOCOL RELATING TO THE APPLICATION OF THE VIENNA CONVENTION AND THE PARIS CONVENTION

Notes: The Joint Protocol was adopted on 21 September 1988 and entered into force on 27 April 1992, in accordance with Article VII. For States depositing an instrument expressing consent to be bound after that date, the Joint Protocol enters into force three months after the date of such deposit. For States depositing an instrument, or instruments, expressing consent to be bound by both the Vienna Convention and the Joint Protocol at the same time, the Joint Protocol enters into force three months after the date of entry into force of the Vienna Convention for such States, in line with the requirements of Article VI of the Joint Protocol.

<3> On 7 July 1992, the Republic of Slovenia had deposited a notification of succession to the Vienna Convention on Civil Liability for Nuclear Damage, with effect from 25 June 1991. On 9 November 2001, the Republic of Slovenia notified the Depositary of the termination of the application of the Vienna Convention for the Republic of Slovenia and of the Republic of Slovenia's accession to the Paris Convention on Third Party Liability in the Field of Nuclear Energy. Pursuant to Article XXV.2 thereof, the Cienna Convention ceased to apply to Slovenia as of 12 November 2002.
DECLARATIONS/RESERVATIONS AND OBJECTIONS THERETO
Belgium, Kingdom of
«For States which limit the amount of the liability of the operator and which are parties to the Vienna Convention and the Joint Protocol, the Kingdom of Belgium reserves the right to provide, in the case of a nuclear incident occurring in its territory and engaging the liability of an operator of a Belgian nuclear installation, that this operator shall be liable for the nuclear damage caused in a foreign country up to the amount envisaged with regard to the Kingdom of Belgium by the national law of the State concerned, at the time of the accident, for compensation for nuclear damage caused in Belgian territory.»
France (French Republic)
«France makes a reservation regarding subparagraph 2 of Article IV, specifying that, for States which limit the amount of the liability of the operator and which are Parties to the Vienna Convention and the Joint Protocol, France reserves the right to provide, in case of nuclear accident in its territory, that the operator responsible shall be liable for the nuclear damage caused in the territory of one or several of these States up to the amount provided for by the national law of these States at the time of the accident for reparation of nuclear damage caused in French territory.»

Switzerland (Swiss Confederation)
«The Swiss Confederation reserves the right to provide that, in the case of a nuclear accident occurring within its territory and involving the liability of a Swiss operator of a nuclear installation, this operator is liable for the nuclear damage caused in a foreign country up to the amount envisaged with regard to Switzerland at the time of the accident by the national legislation of the State concerned, for States which limit the liability amount of the operator and which are parties to the Vienna Convention and the Joint Protocol.»
