Генеральному секретарю Организации Объединенных Наций
Постоянное Представительство Российской Федерации при Организации Объединенных Наций свидетельствует свое уважение Генеральному секретарю Организации Объединенных Наций и имеет честь сообщить о согласии Правительства Российской Федерации на внесение в Соглашение между Правительством Российской Федерации и Организацией Объединенных Наций об учреждении в Российской Федерации Объединенного представительства Организации Объединенных Наций, подписанное 15 июня 1993 г., представленных ООН в Ноте от 29 августа 1995 года изменений:
1. Название Соглашения изложить в следующей редакции:
«Соглашение между Правительством Российской Федерации и Организацией Объединенных Наций об учреждении в Российской Федерации Представительства Организации Объединенных Наций».
2. По тексту Соглашения слова: «Представительство» и «Объединенное представительство» заменить словами: «Представительство Организации Объединенных Наций»; слова: «Глава Представительства» — словами: «Координатор-резидент».
«а) „Представительство Организации Объединенных Наций“ означает местное отделение или, в зависимости от обстоятельств, местные отделения органов системы Организации Объединенных Наций, занимающихся вопросами развития, и там, где это применимо, учреждение, оказывающее гуманитарную помощь в стране»;
«ж) „Координатор-резидент“ означает должностное лицо, назначенное для координации оперативной деятельности в целях развития системы развития Организации Объединенных Наций в стране и там, где это применимо, гуманитарной помощи по линии соответствующего органа»;
подпункт «б» пункта 1 статьи VI:
«б) могут переводить свои фонды, золото или валюту из одной страны в другую или в пределах Российской Федерации в другие учреждения, программы и фонды Организации Объединенных Наций»;
подпункт «а» пункта 1 статьи XIII:
«а) соответствующие служебные помещения для Представительства Организации Объединенных Наций, отдельные или совместные с другими учреждениями, программами и фондами Организации Объединенных Наций»;
«Координатор-резидент или соответственно представители учреждений, программ и фондов Организации Объединенных Наций сообщают Правительству фамилии и категории своих должностных лиц, экспертов в командировках и лиц, оказывающих услуги, и сотрудников, набираемых в Российской Федерации на условиях почасовой оплаты, а также о любом изменении их статуса»;
«1. ПРООН, ЮНИСЕФ, УВКБ, ЮНЕП, ЮНФПА, МПП, ЮНДКП и другие учреждения, программы и фонды Организации Объединенных Наций могут заключать с Правительством дополнительные соглашения относительно условий, на которых они будут сотрудничать с Правительством в осуществлении программ и оперативной деятельности в рамках их соответствующих мандатов»;
«1. Содействие и сотрудничество со стороны Организации Объединенных Наций в рамках программ в соответствии с настоящим Соглашением или каким-либо другим дополнительным соглашением осуществляются в интересах Правительства и народа Российской Федерации, и поэтому Правительство принимает на себя все риски по операциям, проводимым в соответствии с настоящим Соглашением».
Постоянное Представительство Российской Федерации при ООН исходит из того, что настоящая Нота и Нота ООН от 29 августа 1995 года составляют Соглашение между Сторонами относительно предложенных изменений.
Постоянное Представительство Российской Федерации при ООН пользуется случаем, чтобы возобновить Генеральному секретарю ООН уверения в своем весьма высоком уважении.
Организации Объединенных Наций
The United Nations presents its compliments to the Permanent Mission of the Russian Federation to the United Nations and has the honour to refer to the Agreement Between the United Nations and the Government of the Russian Federation Relating to the Establishment of a United Nations Integrated Office, signed on 15 June 1993 (hereafter referred to as the «UNO Agreement»).
In view of General Assembly resolution 48/209 of 21 December 1993 entitled «Operational Activities for Development», concerning the establishment of field offices of the United Nations development system at the country level, the United Nations has the honour to propose the following amendments to the UNO Agreement in order to meet the requirements of the General Assembly in that resolution:
A. Title: The title should be changed to read as follows:
«Agreement Between the United Nations and the Government of the Russian Federation Relating to the Establishment of the United Nations Office in the Russian Federation.»
B. Article I, paragraph (a): The definition of the «United Nations Office» should read as follows:
«The „United Nations Office“ means the field office or, as the case may be, field offices of the United Nations development system and, as applicable, the office providing humanitarian assistance in the country.»
Accordingly, the terms «Office» and «Integrated Office» should be changed throughout the text to «the United Nations Office».
C. Article I, paragraph (g): This paragraph should be changed to read as follows:
«The „Resident Coordinator“ means the official designated to coordinate the operational activities for development of the United Nations development system in the country and, as applicable, humanitarian assistance of the competent office.»
Accordingly, the term the «Head of the Office» should also be changed throughout the text to «the Resident Coordinator».
D. Article VI, paragraph 1 (b): The words «to other organizations or agencies of the United Nations system» should be changed to «to other United Nations Agencies, Programmes and Funds». Accordingly, the paragraph should read as follows:
«(b) shall be free to transfer its funds, gold or currency from one country to another or within the Russian Federation, to other United Nations Agencies, Programmes and Funds.»
E. Article XIII, paragraph 1 (a): The words «system organizations» should be changed to «Agencies, Programmes and Funds». Accordingly, the paragraph should read as follows:
«(a) appropriate office premises for the United Nations Office, alone or in conjunction with other United Nations Agencies, Programmes and Funds;»
F. Article XVI: The term «the Office» at the beginning of the Article should be changed to «the Resident Coordinator or, as appropriate, the Representatives of the United Nations Agencies, Programmes and Funds».
G. Article XVIII, paragraph 1: The words «tasks and projects», at the end of the paragraph, should be changed to «programmes and operational activities». Accordingly, the paragraph should read as follows:
«1. UNDP, UNICEF, UNHCR, UNEP, UNFPA, WFP, UNDCP and other United Nations Agencies, Programmes and Funds may conclude with the Government supplemental agreements concerning conditions under which they shall cooperate with the Government in carrying out programmes and operational activities within their respective mandates.»
H. Article XIX: The words «the United Nations cooperation in programmes» at the beginning of paragraph 1, should be changed to «the assistance to and co-operation in programmes by the United Nations». Accordingly, the paragraph should read as follows:
«1. The assistance to and co-operation in programmes by the United Nations under the present Agreement, or any other supplemental agreement, is provided for the benefit of the Government and people of the Russian Federation and, therefore, the Government shall bear all the risks of the operations under the present Agreement.»
The United Nations proposes that the affirmative reply in writing to this note verbale will constitute the Agreement between the Parties concerning the amendments proposed.
The United Nations avails itself of the opportunity to renew to the Permanent Mission of the Russian Federation the assurances of its highest consideration.
