<a id="p100110"></a>Заключительные положения


1. <a id="p100111"></a>Настоящий Исполнительный протокол вступает в силу и прекращает свое действие одновременно с [Соглашением](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-1).
2. <a id="p100112"></a>По согласию Сторон в настоящий Исполнительный протокол могут быть внесены изменения.

<a id="p100113"></a>Совершено в г. Улан-Баторе 3 сентября 2014 года в двух экземплярах, каждый на русском, монгольском и английском языках, причем все тексты имеют одинаковую силу.
<a id="p100114"></a>В случае разногласий при толковании настоящего Исполнительного протокола Стороны используют текст на английском языке.

**ON THE PROCEDURE FOR THE IMPLEMENTATION OF THE AGREEMENT**
**BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION**
**AND THE GOVERNMENT OF MONGOLIA ON READMISSION**

<a id="p100203"></a>(Ulaanbaatar, 3.IX.2014)

<a id="p100204"></a>The Government of the Russian Federation and the Government of Mongolia hereinafter referred to as the Parties,
<a id="p100205"></a>expressing mutual desire to settle, to the fullest extent possible, the issues relating to the implementation of the Agreement between the Government of the Russian Federation and the Government of Mongolia on readmission, dated September 3, 2014 (hereinafter - the Agreement),
<a id="p100206"></a>have agreed as follows:

<div align="center">

<a id="p100207"></a>Article 1

<a id="p100208"></a>Competent authorities

</div>


1. <a id="p100209"></a>The competent authorities responsible for the implementation of the provisions of the Agreement are:
<a id="p100210"></a>For the Russian Federation:
<a id="p100211"></a>Central competent authority - Federal Migration Service;
<a id="p100212"></a>Competent authorities - Ministry of Foreign Affairs of the Russian Federation and Federal Security Service of the Russian Federation;
<a id="p100213"></a>For Mongolia:
<a id="p100214"></a>Central competent authority - Implementing Agency of the Government of Mongolia - General Agency on Citizenship and Migration;
<a id="p100215"></a>Competent authorities - Ministry of Foreign Affairs of Mongolia and the General Authority for Border Protection of Mongolia.
2. <a id="p100216"></a>The Parties shall immediately inform each other through diplomatic channels of any changes of the competent authorities, referred to in paragraph 1 of this Article.
3. <a id="p100217"></a>For the implementation of the provisions of the Agreement and of this Implementing protocol the central competent authorities of the States of the Parties shall directly cooperate with each other.
4. <a id="p100218"></a>For the implementation of this Implementing protocol the central competent authorities of the States of the Parties shall, within 30 calendar days from the date of signing thereof, shall notify each other in written form through diplomatic channels of their contact data.
5. <a id="p100219"></a>The central competent authorities of the States of the Parties shall immediately inform each other in written form of any changes in their contact data.

<a id="p100220"></a>Article 2

<a id="p100221"></a>Proof of citizenship

</div>


1. <a id="p100222"></a>Citizenship of the Russian Federation shall be confirmed by the following documents:
<a id="p100223"></a>a) diplomatic passport;
<a id="p100224"></a>b) service passport;
<a id="p100225"></a>c) Russian Federation citizen's passport proving the identity of a citizen of the Russian Federation outside the territory of the Russian Federation;
<a id="p100226"></a>d) Russian Federation citizen's domestic passport;
<a id="p100227"></a>e) military identity card with an insert card confirming citizenship of the Russian Federation;
<a id="p100228"></a>f) certificate for entry into (return to) the Russian Federation;
<a id="p100229"></a>g) birth certificate with an insert card confirming citizenship of the Russian Federation;
<a id="p100230"></a>h) birth certificate with an insert card confirming citizenship of the Russian Federation of the parents, one of the parents or a single parent;
<a id="p100231"></a>i) birth certificate with the mark confirming the citizenship of the Russian Federation;
<a id="p100232"></a>j) the documents specified in sub-paragraphs "a - d" of this paragraph approving the citizenship of children, if the information about the children is presented into them and certified with the signature of the official and the seal of the relevant state authority of the Russian Federation.
2. <a id="p100233"></a>Citizenship of Mongolia shall be confirmed by the following documents:
<a id="p100234"></a>a) diplomatic passport;
<a id="p100235"></a>b) official passport;
<a id="p100236"></a>c) Mongolian citizen's foreign passport;
<a id="p100237"></a>d) Mongolian citizen's identity card;
<a id="p100238"></a>e) travel document of Mongolia;
<a id="p100239"></a>f) birth certificate;
<a id="p100240"></a>g) certificate of a competent authority on Mongolian citizenship;
<a id="p100241"></a>h) the documents specified in sub-paragraphs "a - c" of this paragraph approving the citizenship of children, if the information about the children is presented into them and certified with the seal of the relevant state authority of Mongolia.
3. <a id="p100242"></a>A person can be supposed to be a citizen of the Russian Federation if the following items are available:
<a id="p100243"></a>a) the documents referred to in paragraph 1 of this Article, the validity of which has expired;
<a id="p100244"></a>b) copies or duplicates of the documents referred to in paragraph 1 of this Article;
<a id="p100245"></a>c) passport (seaman's identity card);
<a id="p100246"></a>d) the USSR citizen's passport with an insert card confirming citizenship of the Russian Federation;
<a id="p100247"></a>e) the USSR citizen's passport certified with the Russian residence registration stamp on February 6, 1992;
<a id="p100248"></a>f) identity card for the one time crossing astride of Russian-Mongolian border;
<a id="p100249"></a>g) other documents not specified in paragraph 1 of this Article issued by the competent authorities of the Russian Federation;
<a id="p100250"></a>h) statement of the person to be readmitted in accordance with the form set in Annex 1 to this Implementing protocol;
<a id="p100251"></a>i) written explanations of witnesses legally made by relevant competent authorities;
<a id="p100252"></a>j) written explanations of relevant officials;
<a id="p100253"></a>k) the positive results of interview with the person to be readmitted.
4. <a id="p100254"></a>A person can be supposed to be a citizen of Mongolia if the following items are available:
<a id="p100255"></a>a) the documents referred to in paragraph 2 of this Article, the validity of which have expired;
<a id="p100256"></a>b) copies or duplicates of the documents referred to in paragraph 2 of this Article;
<a id="p100257"></a>c) the passport of the Mongolian People's Republic citizens, used until 2000 year;
<a id="p100258"></a>d) the passport of the Mongolian People's Republic citizens with an insert card confirming citizenship of Mongolia;
<a id="p100259"></a>e) insert children card attached to the passport of its parents or guardian (trustee);
<a id="p100260"></a>f) the passport of the parents or guardian (trustee) with the photo of children till 5 years old;
<a id="p100261"></a>g) identity card for the one time crossing astride of Mongolian-Russian border;
<a id="p100262"></a>h) other documents not specified in paragraph 2 of this Article issued by the competent authorities of Mongolia;
<a id="p100263"></a>i) statement of the person to be readmitted in accordance with the form set in Annex 1 to this Implementing protocol;
<a id="p100264"></a>j) written explanations of witnesses legally made by relevant competent authorities;
<a id="p100265"></a>k) written explanations of relevant officials;
<a id="p100266"></a>l) the positive results of interview with the person to be readmitted.

<a id="p100267"></a>Article 3

<a id="p100268"></a>Other documents

</div>


1. <a id="p100269"></a>If the requesting Party considers that other documents which are not listed in Articles 2 of this Implementing protocol may be essential for establishing the nationality of the person to be readmitted, then such documents may be attached to the readmission request.
2. <a id="p100270"></a>The central competent authority of the State of the requested Party decides whether the documents referred to in paragraph 1 of this Article may be taken into consideration in processing the readmission request.

<a id="p100271"></a>Article 4

<a id="p100272"></a>Interview

</div>


1. <a id="p100273"></a>The primary duty for the interview implementation in accordance with paragraph 4 of Article 2 of the Agreement with the person referred to in paragraph 1 of Article 2 of the Agreement, upon the request of the central competent authority of the State of the requesting Party, is laid on the representative of the central competent authority of the State of the requested Party in the State of the requesting Party.
2. <a id="p100274"></a>In case there is no representative of the central competent authority of the State of the requested Party, referred to in paragraph 1 of this Article, the interview shall be carried out by the officials of the diplomatic mission or consular post of the State of the requested Party in the State of the requesting Party.
3. <a id="p100275"></a>The interview shall be held within 14 calendar days from the date of the receiving by the representative of the central competent authority of the State of the requested Party in the territory of the State of the requesting Party or in case mentioned in paragraph 2 of this Article, by the officials of the diplomatic mission or consular post of the State of the requested Party in the State of the requesting Party the request for an interview according to form set forth in Annex 2 to this Implementing protocol.
4. <a id="p100276"></a>The date, time and place of the interview shall be agreed upon by the competent authorities of the States of the Parties in each particular case.

<a id="p100277"></a>Article 5

<a id="p100278"></a>Content and procedure of submission of the readmission<br>
request and also procedure of submission<br>
of the reply thereto

</div>


1. <a id="p100279"></a>The readmission request drawn up according to form set forth in Annex 3 to this Implementing protocol shall be submitted in written form by the central competent authority of the State of the requesting Party to the central competent authority of the State of the requested Party by post or courier.
2. <a id="p100280"></a>The documents available to the requesting Party, specified in Articles 2 and 3 of this Implementing protocol, the availability of which confirms or suggests that the person to be readmitted is a citizen of the State of the requested Party, shall be attached to the readmission request.
3. <a id="p100281"></a>If required, the central competent authority of the State of the requesting Party shall indicate in paragraph "B" of the readmission requests the additional information about the special danger and health status of the person to be readmitted.
4. <a id="p100282"></a>The reply to the readmission request shall be sent to the central competent authority of the State of the requesting Party by the central competent authority of the State of the requested Party in written form by post or courier and additionally, if required, by technical means of information transmission in time limits according to paragraph 2 of Article 4 of the Agreement.

<a id="p100283"></a>Article 6

<a id="p100284"></a>Escorting of a person to be readmitted

</div>


1. <a id="p100285"></a>If the escort is needed for readmission of a person, the central competent authority of the State of the requesting Party shall communicate to the central competent authority of the State the requested Party first names, family names and positions of the members of escort, type, number, date of issue of passports and validity of their passports, as well as supposed time of their stay in the territory of the State of the requested Party.
2. <a id="p100286"></a>The members of escort shall be obliged to obey the legislation of the State of the requested Party while staying in the territory of the State of the requested Party.
3. <a id="p100287"></a>The members of escort shall be in civilian clothes and shall carry valid passports and documents proving the agreed arrangements in respect of the readmission.
4. <a id="p100288"></a>The members of escort may not bear weapons and other items which are restricted or are not allowed in the territory of the State of the requested Party.
5. <a id="p100289"></a>The competent authorities of the States of the Parties shall cooperate with each other on all the issues related to the stay of the members of escort in the territory of the State of the requested Party. If necessary, the competent authorities of the State of the requested Party shall provide the members of escort with possible assistance.

<a id="p100290"></a>Article 7

<a id="p100291"></a>Readmission procedure

</div>


1. <a id="p100292"></a>The readmission of the citizens of the States of the Parties shall be conducted at all border crossing points of the States of the Parties.
2. <a id="p100293"></a>The date and time of the readmission and also the border crossing points of the State of the Parties, used for these purposes, shall be agreed between the competent authorities of the States of the Parties in each particular case.
3. <a id="p100294"></a>The central competent authority of the State of the requesting Party beforehand informs the central competent authority of the State of the requested Party about the transfer modalities for person to be readmitted.
4. <a id="p100295"></a>The central competent authority of the State of the requested Party not later than 4 working days from the date of receiving the information specified in paragraph 3 of this Article, shall notify the central competent authority of the State of the requesting Party of the acceptability of the modalities of the transfer of person to be readmitted.
5. <a id="p100296"></a>In case if the transfer modalities proposed by the central competent authority of the State of the requesting Party are not acceptable to the central competent authority of the State of the requested Party, other modalities for the transfer shall be arranged as soon as possible.

<a id="p100298"></a>Language

</div>


1. <a id="p100299"></a>For the implementation of the provisions of the Agreement and of this Implementing protocol the documents listed in Annexes 1 - 3 to this Implementing protocol shall be drawn up:

<a id="p100304"></a>Costs

</div>


1. <a id="p100305"></a>Costs incurred by the requested Party in connection with readmission in accordance with paragraphs 1 and 3 of Article 7 of the Agreement shall be reimbursed by the requesting Party in US dollars within 30 calendar days upon receiving of the notification of the costs incurred accompanied by financial documents confirming the costs incurred.
2. <a id="p100306"></a>Costs incurred by one Party in connection with transfer of the persons, indicated in paragraph 5 of Article 2 of the Agreement shall be reimbursed in accordance with paragraph 2 of Article 7 of the Agreement by the Party responsible for the readmission in error of the person in US dollars within 30 calendar days upon receiving of the notification by the other Party of the costs incurred accompanied by financial documents confirming the costs incurred.

1. <a id="p100312"></a>This Implementing protocol shall enter into force and cease to be in force simultaneously with the Agreement.
2. <a id="p100313"></a>The Parties may, upon mutual consent, make amendments to this Implementing protocol.

<a id="p100314"></a>Done at Ulaanbaatar on the 3rd of September, 2014 in two original copies, each in the Russian, Mongolian and English languages, all texts being equally authentic.
<a id="p100315"></a>In case of divergence in interpretation of this Implementing protocol the English text shall be used.
