## Статья 1

## <a id="p100001"></a>ИСПОЛНИТЕЛЬНЫЙ ПРОТОКОЛ

**О ПОРЯДКЕ РЕАЛИЗАЦИИ СОГЛАШЕНИЯ МЕЖДУ ПРАВИТЕЛЬСТВОМ**
**РОССИЙСКОЙ ФЕДЕРАЦИИ И ПРАВИТЕЛЬСТВОМ МОНГОЛИИ О РЕАДМИССИИ**

<a id="p100003"></a>Правительство Российской Федерации и Правительство Монголии, именуемые в дальнейшем Сторонами,
<a id="p100004"></a>выражая обоюдное желание наиболее полно урегулировать вопросы, связанные с реализацией [Соглашения](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-8#p100054) между Правительством Российской Федерации и Правительством Монголии о реадмиссии от 3 сентября 2014 года (далее - Соглашение),
<a id="p100005"></a>согласились о нижеследующем:


### <a id="p100006"></a>Статья 1

<a id="p100007"></a>Компетентные органы


1. <a id="p100008"></a>Компетентными органами, ответственными за реализацию положений [Соглашения](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-1), являются:
<a id="p100009"></a>от Российской Федерации:
<a id="p100010"></a>центральный компетентный орган - Федеральная миграционная служба;
<a id="p100011"></a>компетентные органы - Министерство иностранных дел Российской Федерации и Федеральная служба безопасности Российской Федерации;
<a id="p100012"></a>от Монголии:
<a id="p100013"></a>центральный компетентный орган - Исполнительное агентство Правительства Монголии - Главное управление по гражданству и миграции;
<a id="p100014"></a>компетентные органы - Министерство иностранных дел Монголии и Главное управление пограничной охраны Монголии.
2. <a id="p100015"></a>Об изменениях компетентных органов, указанных в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-1#p100008) настоящей статьи, Стороны незамедлительно информируют друг друга по дипломатическим каналам.
3. <a id="p100016"></a>В целях реализации положений [Соглашения](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-1) и настоящего Исполнительного протокола центральные компетентные органы государств Сторон взаимодействуют между собой непосредственно.
4. <a id="p100017"></a>В целях реализации настоящего Исполнительного протокола центральные компетентные органы государств Сторон в течение 30 календарных дней с даты его подписания сообщают друг другу в письменной форме по дипломатическим каналам свои контактные данные.
5. <a id="p100018"></a>Центральные компетентные органы государств Сторон незамедлительно сообщают друг другу в письменной форме об изменениях своих контактных данных.

## Статья 2

### <a id="p100019"></a>Статья 2

<a id="p100020"></a>Доказательства наличия гражданства


1. <a id="p100021"></a>Наличие гражданства Российской Федерации подтверждается следующими документами:
<a id="p100022"></a>a) дипломатический паспорт;
<a id="p100023"></a>b) служебный паспорт;
<a id="p100024"></a>c) паспорт гражданина Российской Федерации, удостоверяющий личность гражданина Российской Федерации за пределами территории Российской Федерации;
<a id="p100025"></a>d) паспорт гражданина Российской Федерации;
<a id="p100026"></a>e) удостоверение личности (военный билет) военнослужащего с вкладышем о гражданстве Российской Федерации;
<a id="p100027"></a>f) свидетельство на въезд (возвращение) в Российскую Федерацию;
<a id="p100028"></a>g) свидетельство о рождении с вкладышем о гражданстве Российской Федерации;
<a id="p100029"></a>h) свидетельство о рождении с внесенными сведениями о российском гражданстве родителей, одного из родителей или единственного родителя;
<a id="p100030"></a>i) свидетельство о рождении с отметкой, подтверждающей наличие гражданства Российской Федерации;
<a id="p100031"></a>j) документы, указанные в [подпунктах "a"](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100022) - ["d"](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100025) настоящего пункта, подтверждают гражданство детей при наличии в них заверенных подписью должностного лица и печатью соответствующего государственного органа Российской Федерации сведений об указанных детях.
2. <a id="p100032"></a>Наличие гражданства Монголии подтверждается следующими документами:
<a id="p100033"></a>a) дипломатический паспорт;
<a id="p100034"></a>b) служебный паспорт;
<a id="p100035"></a>c) заграничный паспорт гражданина Монголии;
<a id="p100036"></a>d) удостоверение гражданина Монголии;
<a id="p100037"></a>e) проездной документ для возвращения в Монголию;
<a id="p100038"></a>f) свидетельство о рождении;
<a id="p100039"></a>g) справка компетентного органа о наличии гражданства Монголии;
<a id="p100040"></a>h) документы, указанные в [подпунктах "a"](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100033) - ["c"](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100035) настоящего пункта, подтверждают гражданство детей при наличии в них заверенных печатью соответствующего государственного органа Монголии сведений об указанных детях.
3. <a id="p100041"></a>Основания полагать, что лицо имеет гражданство Российской Федерации, имеются при наличии:
<a id="p100042"></a>a) документов, указанных в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100021) настоящей статьи, срок действия которых истек;
<a id="p100043"></a>b) копий или дубликатов документов, указанных в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100021) настоящей статьи;
<a id="p100044"></a>c) паспорта моряка (удостоверения личности моряка);
<a id="p100045"></a>d) паспорта гражданина СССР с вкладышем о принадлежности к гражданству Российской Федерации;
<a id="p100046"></a>e) паспорта гражданина СССР со штампом о прописке по месту жительства на территории Российской Федерации на 6 февраля 1992 г.;
<a id="p100047"></a>f) удостоверения на разовое пересечение российско-монгольской государственной границы в обе стороны;
<a id="p100048"></a>g) иных документов, помимо указанных в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100021) настоящей статьи, выданных соответствующими компетентными органами Российской Федерации;
<a id="p100049"></a>h) заявления по [форме](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100118) согласно Приложению N 1 к настоящему Исполнительному протоколу, заполненного лицом, подлежащим реадмиссии;
<a id="p100050"></a>i) письменных пояснений свидетелей, взятых на законных основаниях соответствующими компетентными органами;
<a id="p100051"></a>j) письменных пояснений компетентных должностных лиц;
<a id="p100052"></a>k) положительных результатов собеседования с лицом, подлежащим реадмиссии.
4. <a id="p100053"></a>Основания полагать, что лицо имеет гражданство Монголии, имеются при наличии:
<a id="p100054"></a>a) документов, указанных в [пункте 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100032) настоящей статьи, срок действия которых истек;
<a id="p100055"></a>b) копий или дубликатов документов, указанных в [пункте 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100032) настоящей статьи;
<a id="p100056"></a>c) паспорта гражданина Монгольской Народной Республики, который использовался до 2000 г.;
<a id="p100057"></a>d) паспорта гражданина Монгольской Народной Республики с вкладышем о принадлежности к гражданству Монголии;
<a id="p100058"></a>e) вкладыша для детей, приложенного к паспорту родителя или опекуна (попечителя);
<a id="p100059"></a>f) паспорта родителя или опекуна (попечителя) с фотографией ребенка до 5 лет;
<a id="p100060"></a>g) удостоверения на разовое пересечение монгольско-российской государственной границы в обе стороны;
<a id="p100061"></a>h) иных документов, помимо указанных в [пункте 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100032) настоящей статьи, выданных соответствующими компетентными органами Монголии;
<a id="p100062"></a>i) заявления по [форме](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100118) согласно Приложению N 1 к настоящему Исполнительному протоколу, заполненного лицом, подлежащим реадмиссии;
<a id="p100063"></a>j) письменных пояснений свидетелей, взятых на законных основаниях соответствующими компетентными органами;
<a id="p100064"></a>k) письменных пояснений компетентных должностных лиц;
<a id="p100065"></a>l) положительных результатов собеседования с лицом, подлежащим реадмиссии.

## Статья 3

### <a id="p100066"></a>Статья 3

<a id="p100067"></a>Иные документы


1. <a id="p100068"></a>Если, по мнению запрашивающей Стороны, иные документы, не предусмотренные [статьей 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100019) настоящего Исполнительного протокола, могут иметь существенное значение для определения гражданской принадлежности лица, подлежащего реадмиссии, то такие документы могут быть также приложены к запросу о реадмиссии.
2. <a id="p100069"></a>Вопрос о возможности принятия во внимание документов, указанных в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-3#p100068) настоящей статьи, при рассмотрении запроса о реадмиссии решается центральным компетентным органом государства запрашиваемой Стороны.

## Статья 4

### <a id="p100070"></a>Статья 4

<a id="p100071"></a>Собеседование


1. <a id="p100072"></a>Основная обязанность по проведению собеседования по запросу центрального компетентного органа государства запрашивающей Стороны в соответствии с [пунктом 4 статьи 2](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-2#p100026) Соглашения с лицом, указанным в [пункте 1 статьи 2](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-2#p100022) Соглашения, возлагается на представителя центрального компетентного органа государства запрашиваемой Стороны в государстве запрашивающей Стороны.
2. <a id="p100073"></a>В отсутствие представителя центрального компетентного органа государства запрашиваемой Стороны, указанного в [пункте 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-4#p100072) настоящей статьи, собеседование проводится сотрудником дипломатического представительства или консульского учреждения государства запрашиваемой Стороны в государстве запрашивающей Стороны.
3. <a id="p100074"></a>Собеседование должно быть проведено в срок, не превышающий 14 календарных дней с даты получения представителем центрального компетентного органа государства запрашиваемой Стороны, находящимся на территории государства запрашивающей Стороны, либо (в случае, предусмотренном [пунктом 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-4#p100073) настоящей статьи) дипломатическим представительством или консульским учреждением государства запрашиваемой Стороны в государстве запрашивающей Стороны запроса о проведении собеседования, составленного по [форме](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100142) согласно Приложению N 2 к настоящему Исполнительному протоколу.
4. <a id="p100075"></a>Дата, время и место проведения собеседования согласовываются компетентными органами государств Сторон в каждом конкретном случае.

## Статья 5

### <a id="p100076"></a>Статья 5

<a id="p100077"></a>Содержание и порядок направления запроса о реадмиссии,<br> а также порядок направления ответа на него


1. <a id="p100078"></a>Запрос о реадмиссии, составленный по [форме](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100173) согласно Приложению N 3 к настоящему Исполнительному протоколу, направляется в письменной форме центральным компетентным органом государства запрашивающей Стороны центральному компетентному органу государства запрашиваемой Стороны посредством почтовой связи или с курьером.
2. <a id="p100079"></a>К запросу о реадмиссии прилагаются имеющиеся в распоряжении запрашивающей Стороны документы, предусмотренные [статьями 2](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-2#p100019) и [3](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-3#p100066) настоящего Исполнительного протокола, наличие которых подтверждает либо дает основание предполагать, что у лица, подлежащего реадмиссии, имеется гражданство государства запрашиваемой Стороны.
3. <a id="p100080"></a>В случае необходимости центральный компетентный орган государства запрашивающей Стороны указывает в [пункте "B"](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100190) запроса о реадмиссии дополнительную информацию об особой опасности и состоянии здоровья лица, подлежащего реадмиссии.
4. <a id="p100081"></a>Ответ на запрос о реадмиссии направляется в центральный компетентный орган государства запрашивающей Стороны центральным компетентным органом государства запрашиваемой Стороны в письменной форме посредством почтовой связи или с курьером и при необходимости дополнительно при помощи технических средств передачи информации в сроки, установленные [пунктом 2 статьи 4](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-4#p100035) Соглашения.

## Статья 6

### <a id="p100082"></a>Статья 6

<a id="p100083"></a>Сопровождение лица, подлежащего реадмиссии


1. <a id="p100084"></a>В случае необходимости реадмиссии лица с сопровождением центральный компетентный орган государства запрашивающей Стороны сообщает центральному компетентному органу государства запрашиваемой Стороны имена, фамилии и должности сопровождающих лиц, вид, номер, дату выдачи и срок действия их паспортов, а также предполагаемые сроки их пребывания на территории государства запрашиваемой Стороны.
2. <a id="p100085"></a>Сопровождающие лица обязаны соблюдать законодательство государства запрашиваемой Стороны во время пребывания на территории государства запрашиваемой Стороны.
3. <a id="p100086"></a>Сопровождающие лица должны быть в гражданской одежде, а также иметь при себе действительные паспорта и документы, свидетельствующие о согласованной договоренности в отношении реадмиссии.
4. <a id="p100087"></a>Сопровождающие лица не могут иметь при себе оружие и иные предметы, ограниченные или изъятые из оборота на территории государства запрашиваемой Стороны.
5. <a id="p100088"></a>Компетентные органы государств Сторон взаимодействуют друг с другом по всем вопросам, связанным с обеспечением пребывания сопровождающих лиц на территории государства запрашиваемой Стороны. При этом компетентные органы государства запрашиваемой Стороны при необходимости оказывают возможное содействие сопровождающим лицам.

## Статья 7

### <a id="p100089"></a>Статья 7

<a id="p100090"></a>Процедура реадмиссии


1. <a id="p100091"></a>Реадмиссия граждан государств Сторон осуществляется во всех пунктах пропуска через государственную границу государств Сторон.
2. <a id="p100092"></a>Дата и время реадмиссии, а также используемые в этих целях пункты пропуска через государственную границу государств Сторон определяются по взаимному согласию компетентных органов государств Сторон в каждом конкретном случае.
3. <a id="p100093"></a>Центральный компетентный орган государства запрашивающей Стороны заблаговременно уведомляет центральный компетентный орган государства запрашиваемой Стороны об условиях передачи лица, подлежащего реадмиссии.
4. <a id="p100094"></a>Центральный компетентный орган государства запрашиваемой Стороны не позднее чем через 4 рабочих дня с даты получения информации, указанной в [пункте 3](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-7#p100093) настоящей статьи, уведомляет центральный компетентный орган государства запрашивающей Стороны о приемлемости условий передачи лица, подлежащего реадмиссии.
5. <a id="p100095"></a>В случае если предложенные центральным компетентным органом государства запрашивающей Стороны условия передачи являются неприемлемыми для центрального компетентного органа запрашиваемой Стороны, другие условия передачи должны быть организованы в возможно короткий срок.

## Статья 8

### <a id="p100096"></a>Статья 8

<a id="p100097"></a>Язык


1. <a id="p100098"></a>В целях реализации положений [Соглашения](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-1) и настоящего Исполнительного протокола документы, предусмотренные [Приложениями N 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100118) - [3](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100173) к настоящему Исполнительному протоколу, оформляются:
<a id="p100099"></a>Российской Стороной - на русском языке с приложением перевода на монгольский или английский язык;
<a id="p100100"></a>Монгольской Стороной - на монгольском языке с приложением перевода на русский или английский язык.
2. <a id="p100101"></a>Консультации между компетентными органами по вопросам реализации настоящего Исполнительного протокола осуществляются на английском языке, если Стороны в каждом конкретном случае не договорятся об ином.

## Статья 9

### <a id="p100102"></a>Статья 9

<a id="p100103"></a>Расходы


1. <a id="p100104"></a>Расходы, понесенные запрашиваемой Стороной при осуществлении реадмиссии, возмещаются в соответствии с [пунктами 1](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-7#p100051) и [3 статьи 7](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-7#p100053) Соглашения запрашивающей Стороной в долларах США в течение 30 календарных дней с даты получения ею уведомления о произведенных расходах с приложением финансовых документов, подтверждающих произведенные затраты.
2. <a id="p100105"></a>Расходы, понесенные одной Стороной при передаче лиц, указанных в [пункте 5 статьи 2](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-2#p100027) Соглашения, возмещаются в соответствии с [пунктом 2 статьи 7](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-7#p100052) Соглашения Стороной, ответственной за ошибочную реадмиссию лица, в долларах США в течение 30 календарных дней с даты получения уведомления другой Стороны о произведенных расходах с приложением финансовых документов, подтверждающих произведенные затраты.

<a id="p100107"></a>Приложения


<a id="p100108"></a>[Приложения N 1](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100118) - [3](https://bukva.ai/docs/ispolnitelnyy-protokol-o-poryadke-realizatsii-9/statya-11#p100173) к настоящему Исполнительному протоколу являются его неотъемлемой частью.

## Статья 11

### <a id="p100109"></a>Статья 11

<a id="p100110"></a>Заключительные положения


1. <a id="p100111"></a>Настоящий Исполнительный протокол вступает в силу и прекращает свое действие одновременно с [Соглашением](https://bukva.ai/docs/soglashenie-mezhdu-pravitelstvom-rossiyskoy-2586/statya-1).
2. <a id="p100112"></a>По согласию Сторон в настоящий Исполнительный протокол могут быть внесены изменения.

<a id="p100113"></a>Совершено в г. Улан-Баторе 3 сентября 2014 года в двух экземплярах, каждый на русском, монгольском и английском языках, причем все тексты имеют одинаковую силу.
<a id="p100114"></a>В случае разногласий при толковании настоящего Исполнительного протокола Стороны используют текст на английском языке.

**ON THE PROCEDURE FOR THE IMPLEMENTATION OF THE AGREEMENT**
**BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION**
**AND THE GOVERNMENT OF MONGOLIA ON READMISSION**

<a id="p100203"></a>(Ulaanbaatar, 3.IX.2014)

<a id="p100204"></a>The Government of the Russian Federation and the Government of Mongolia hereinafter referred to as the Parties,
<a id="p100205"></a>expressing mutual desire to settle, to the fullest extent possible, the issues relating to the implementation of the Agreement between the Government of the Russian Federation and the Government of Mongolia on readmission, dated September 3, 2014 (hereinafter - the Agreement),
<a id="p100206"></a>have agreed as follows:

<div align="center">

<a id="p100207"></a>Article 1

<a id="p100208"></a>Competent authorities

</div>


1. <a id="p100209"></a>The competent authorities responsible for the implementation of the provisions of the Agreement are:
<a id="p100210"></a>For the Russian Federation:
<a id="p100211"></a>Central competent authority - Federal Migration Service;
<a id="p100212"></a>Competent authorities - Ministry of Foreign Affairs of the Russian Federation and Federal Security Service of the Russian Federation;
<a id="p100213"></a>For Mongolia:
<a id="p100214"></a>Central competent authority - Implementing Agency of the Government of Mongolia - General Agency on Citizenship and Migration;
<a id="p100215"></a>Competent authorities - Ministry of Foreign Affairs of Mongolia and the General Authority for Border Protection of Mongolia.
2. <a id="p100216"></a>The Parties shall immediately inform each other through diplomatic channels of any changes of the competent authorities, referred to in paragraph 1 of this Article.
3. <a id="p100217"></a>For the implementation of the provisions of the Agreement and of this Implementing protocol the central competent authorities of the States of the Parties shall directly cooperate with each other.
4. <a id="p100218"></a>For the implementation of this Implementing protocol the central competent authorities of the States of the Parties shall, within 30 calendar days from the date of signing thereof, shall notify each other in written form through diplomatic channels of their contact data.
5. <a id="p100219"></a>The central competent authorities of the States of the Parties shall immediately inform each other in written form of any changes in their contact data.

<a id="p100220"></a>Article 2

<a id="p100221"></a>Proof of citizenship

</div>


1. <a id="p100222"></a>Citizenship of the Russian Federation shall be confirmed by the following documents:
<a id="p100223"></a>a) diplomatic passport;
<a id="p100224"></a>b) service passport;
<a id="p100225"></a>c) Russian Federation citizen's passport proving the identity of a citizen of the Russian Federation outside the territory of the Russian Federation;
<a id="p100226"></a>d) Russian Federation citizen's domestic passport;
<a id="p100227"></a>e) military identity card with an insert card confirming citizenship of the Russian Federation;
<a id="p100228"></a>f) certificate for entry into (return to) the Russian Federation;
<a id="p100229"></a>g) birth certificate with an insert card confirming citizenship of the Russian Federation;
<a id="p100230"></a>h) birth certificate with an insert card confirming citizenship of the Russian Federation of the parents, one of the parents or a single parent;
<a id="p100231"></a>i) birth certificate with the mark confirming the citizenship of the Russian Federation;
<a id="p100232"></a>j) the documents specified in sub-paragraphs "a - d" of this paragraph approving the citizenship of children, if the information about the children is presented into them and certified with the signature of the official and the seal of the relevant state authority of the Russian Federation.
2. <a id="p100233"></a>Citizenship of Mongolia shall be confirmed by the following documents:
<a id="p100234"></a>a) diplomatic passport;
<a id="p100235"></a>b) official passport;
<a id="p100236"></a>c) Mongolian citizen's foreign passport;
<a id="p100237"></a>d) Mongolian citizen's identity card;
<a id="p100238"></a>e) travel document of Mongolia;
<a id="p100239"></a>f) birth certificate;
<a id="p100240"></a>g) certificate of a competent authority on Mongolian citizenship;
<a id="p100241"></a>h) the documents specified in sub-paragraphs "a - c" of this paragraph approving the citizenship of children, if the information about the children is presented into them and certified with the seal of the relevant state authority of Mongolia.
3. <a id="p100242"></a>A person can be supposed to be a citizen of the Russian Federation if the following items are available:
<a id="p100243"></a>a) the documents referred to in paragraph 1 of this Article, the validity of which has expired;
<a id="p100244"></a>b) copies or duplicates of the documents referred to in paragraph 1 of this Article;
<a id="p100245"></a>c) passport (seaman's identity card);
<a id="p100246"></a>d) the USSR citizen's passport with an insert card confirming citizenship of the Russian Federation;
<a id="p100247"></a>e) the USSR citizen's passport certified with the Russian residence registration stamp on February 6, 1992;
<a id="p100248"></a>f) identity card for the one time crossing astride of Russian-Mongolian border;
<a id="p100249"></a>g) other documents not specified in paragraph 1 of this Article issued by the competent authorities of the Russian Federation;
<a id="p100250"></a>h) statement of the person to be readmitted in accordance with the form set in Annex 1 to this Implementing protocol;
<a id="p100251"></a>i) written explanations of witnesses legally made by relevant competent authorities;
<a id="p100252"></a>j) written explanations of relevant officials;
<a id="p100253"></a>k) the positive results of interview with the person to be readmitted.
4. <a id="p100254"></a>A person can be supposed to be a citizen of Mongolia if the following items are available:
<a id="p100255"></a>a) the documents referred to in paragraph 2 of this Article, the validity of which have expired;
<a id="p100256"></a>b) copies or duplicates of the documents referred to in paragraph 2 of this Article;
<a id="p100257"></a>c) the passport of the Mongolian People's Republic citizens, used until 2000 year;
<a id="p100258"></a>d) the passport of the Mongolian People's Republic citizens with an insert card confirming citizenship of Mongolia;
<a id="p100259"></a>e) insert children card attached to the passport of its parents or guardian (trustee);
<a id="p100260"></a>f) the passport of the parents or guardian (trustee) with the photo of children till 5 years old;
<a id="p100261"></a>g) identity card for the one time crossing astride of Mongolian-Russian border;
<a id="p100262"></a>h) other documents not specified in paragraph 2 of this Article issued by the competent authorities of Mongolia;
<a id="p100263"></a>i) statement of the person to be readmitted in accordance with the form set in Annex 1 to this Implementing protocol;
<a id="p100264"></a>j) written explanations of witnesses legally made by relevant competent authorities;
<a id="p100265"></a>k) written explanations of relevant officials;
<a id="p100266"></a>l) the positive results of interview with the person to be readmitted.

<a id="p100267"></a>Article 3

<a id="p100268"></a>Other documents

</div>


1. <a id="p100269"></a>If the requesting Party considers that other documents which are not listed in Articles 2 of this Implementing protocol may be essential for establishing the nationality of the person to be readmitted, then such documents may be attached to the readmission request.
2. <a id="p100270"></a>The central competent authority of the State of the requested Party decides whether the documents referred to in paragraph 1 of this Article may be taken into consideration in processing the readmission request.

<a id="p100271"></a>Article 4

<a id="p100272"></a>Interview

</div>


1. <a id="p100273"></a>The primary duty for the interview implementation in accordance with paragraph 4 of Article 2 of the Agreement with the person referred to in paragraph 1 of Article 2 of the Agreement, upon the request of the central competent authority of the State of the requesting Party, is laid on the representative of the central competent authority of the State of the requested Party in the State of the requesting Party.
2. <a id="p100274"></a>In case there is no representative of the central competent authority of the State of the requested Party, referred to in paragraph 1 of this Article, the interview shall be carried out by the officials of the diplomatic mission or consular post of the State of the requested Party in the State of the requesting Party.
3. <a id="p100275"></a>The interview shall be held within 14 calendar days from the date of the receiving by the representative of the central competent authority of the State of the requested Party in the territory of the State of the requesting Party or in case mentioned in paragraph 2 of this Article, by the officials of the diplomatic mission or consular post of the State of the requested Party in the State of the requesting Party the request for an interview according to form set forth in Annex 2 to this Implementing protocol.
4. <a id="p100276"></a>The date, time and place of the interview shall be agreed upon by the competent authorities of the States of the Parties in each particular case.

<a id="p100277"></a>Article 5

<a id="p100278"></a>Content and procedure of submission of the readmission<br>
request and also procedure of submission<br>
of the reply thereto

</div>


1. <a id="p100279"></a>The readmission request drawn up according to form set forth in Annex 3 to this Implementing protocol shall be submitted in written form by the central competent authority of the State of the requesting Party to the central competent authority of the State of the requested Party by post or courier.
2. <a id="p100280"></a>The documents available to the requesting Party, specified in Articles 2 and 3 of this Implementing protocol, the availability of which confirms or suggests that the person to be readmitted is a citizen of the State of the requested Party, shall be attached to the readmission request.
3. <a id="p100281"></a>If required, the central competent authority of the State of the requesting Party shall indicate in paragraph "B" of the readmission requests the additional information about the special danger and health status of the person to be readmitted.
4. <a id="p100282"></a>The reply to the readmission request shall be sent to the central competent authority of the State of the requesting Party by the central competent authority of the State of the requested Party in written form by post or courier and additionally, if required, by technical means of information transmission in time limits according to paragraph 2 of Article 4 of the Agreement.

<a id="p100283"></a>Article 6

<a id="p100284"></a>Escorting of a person to be readmitted

</div>


1. <a id="p100285"></a>If the escort is needed for readmission of a person, the central competent authority of the State of the requesting Party shall communicate to the central competent authority of the State the requested Party first names, family names and positions of the members of escort, type, number, date of issue of passports and validity of their passports, as well as supposed time of their stay in the territory of the State of the requested Party.
2. <a id="p100286"></a>The members of escort shall be obliged to obey the legislation of the State of the requested Party while staying in the territory of the State of the requested Party.
3. <a id="p100287"></a>The members of escort shall be in civilian clothes and shall carry valid passports and documents proving the agreed arrangements in respect of the readmission.
4. <a id="p100288"></a>The members of escort may not bear weapons and other items which are restricted or are not allowed in the territory of the State of the requested Party.
5. <a id="p100289"></a>The competent authorities of the States of the Parties shall cooperate with each other on all the issues related to the stay of the members of escort in the territory of the State of the requested Party. If necessary, the competent authorities of the State of the requested Party shall provide the members of escort with possible assistance.

<a id="p100290"></a>Article 7

<a id="p100291"></a>Readmission procedure

</div>


1. <a id="p100292"></a>The readmission of the citizens of the States of the Parties shall be conducted at all border crossing points of the States of the Parties.
2. <a id="p100293"></a>The date and time of the readmission and also the border crossing points of the State of the Parties, used for these purposes, shall be agreed between the competent authorities of the States of the Parties in each particular case.
3. <a id="p100294"></a>The central competent authority of the State of the requesting Party beforehand informs the central competent authority of the State of the requested Party about the transfer modalities for person to be readmitted.
4. <a id="p100295"></a>The central competent authority of the State of the requested Party not later than 4 working days from the date of receiving the information specified in paragraph 3 of this Article, shall notify the central competent authority of the State of the requesting Party of the acceptability of the modalities of the transfer of person to be readmitted.
5. <a id="p100296"></a>In case if the transfer modalities proposed by the central competent authority of the State of the requesting Party are not acceptable to the central competent authority of the State of the requested Party, other modalities for the transfer shall be arranged as soon as possible.

<a id="p100297"></a>Article 8

<a id="p100298"></a>Language

</div>


1. <a id="p100299"></a>For the implementation of the provisions of the Agreement and of this Implementing protocol the documents listed in Annexes 1 - 3 to this Implementing protocol shall be drawn up:
<a id="p100300"></a>By the Russian Party - in Russian language with translation into Mongolian or English languages attached;
<a id="p100301"></a>9 By the Mongolian Party - in Mongolian language with translation into Russian or English languages attached.
2. <a id="p100302"></a>Consultations of the competent authorities concerning the implementation of this Implementing protocol shall be held in English language unless the Parties agree otherwise in each particular case.

<a id="p100303"></a>Article 9

<a id="p100304"></a>Costs

</div>


1. <a id="p100305"></a>Costs incurred by the requested Party in connection with readmission in accordance with paragraphs 1 and 3 of Article 7 of the Agreement shall be reimbursed by the requesting Party in US dollars within 30 calendar days upon receiving of the notification of the costs incurred accompanied by financial documents confirming the costs incurred.
2. <a id="p100306"></a>Costs incurred by one Party in connection with transfer of the persons, indicated in paragraph 5 of Article 2 of the Agreement shall be reimbursed in accordance with paragraph 2 of Article 7 of the Agreement by the Party responsible for the readmission in error of the person in US dollars within 30 calendar days upon receiving of the notification by the other Party of the costs incurred accompanied by financial documents confirming the costs incurred.

<a id="p100309"></a>Annexes 1 - 3 to this Implementing protocol shall be its integral part.

<a id="p100310"></a>Article 11

<a id="p100311"></a>Final Provisions

</div>


1. <a id="p100312"></a>This Implementing protocol shall enter into force and cease to be in force simultaneously with the Agreement.
2. <a id="p100313"></a>The Parties may, upon mutual consent, make amendments to this Implementing protocol.

<a id="p100314"></a>Done at Ulaanbaatar on the 3rd of September, 2014 in two original copies, each in the Russian, Mongolian and English languages, all texts being equally authentic.
<a id="p100315"></a>In case of divergence in interpretation of this Implementing protocol the English text shall be used.
