Вступление в силу и прекращение

1. Настоящий Исполнительный протокол вступает в силу в тот же день, что и Соглашение.

2. Действие настоящего Исполнительного протокола прекращается в момент прекращения действия Соглашения.

Совершено в г. Берне 21 сентября 2009 года в двух экземплярах, каждый на русском, немецком и английском языках, причем все тексты имеют одинаковую силу.

Для целей толкования настоящего Исполнительного протокола будет использоваться текст на английском языке.

TO THE AGREEMENT BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION AND THE FEDERAL COUNCIL OF THE SWISS CONFEDERATION ON READMISSION

(Bern, 21.IX.2009)

The Government of the Russian Federation and the Federal Council of the Swiss Confederation, hereinafter referred to as «the Parties»,

According to Article 21 of the Agreement between the Government of the Russian Federation and the Federal Council of the Swiss Confederation on readmission of 21 September, 2009 (hereinafter referred to as the «Agreement») have agreed as follows:

Article 1

Competent Authorities

1. The competent authorities responsible for the implementation of the Agreement are:

a) for the Russian Federation:

central competent authority:

Federal Migration Service;

competent authorities:

Ministry of Foreign Affairs of the Russian Federation;
Federal Security Service of the Russian Federation;

b) for the Swiss Confederation:

central competent authority:

Federal Office for Migration;

competent authorities:

Federal Department of Justice and Police;
Federal Department of Foreign Affairs within its competences.

2. The Parties shall immediately inform each other through diplomatic channels of any change in the list of the competent authorities.

Article 2

Readmission Application

1. The readmission application shall be submitted by the central competent authority of the requesting State directly to the central competent authority of the requested State by mail.

2. The reply to the readmission application shall be submitted to the central competent authority of the requesting State directly by the central competent authority of the requested State by mail.

3. For the readmission application a form is to be used which corresponds to Annex 1 of this Implementing Protocol.

Article 3

Exchange of document samples

In order to implement the Agreement, the central competent authorities of the Parties shall exchange, through diplomatic channels, samples of appropriate documents referred to in Annex 1 to the Agreement.

Article 4

Other Documents

1. If the requesting State considers that other documents not listed in Annexes 1 to 4 to the Agreement may be essential for establishing the nationality of the person to be readmitted, such documents may be submitted to the requested State together with the readmission application.

2. The decision as to whether the documents listed in paragraph 1 of this Article may be taken into account in processing the readmission application shall be made by the requested State.

Article 5

Interview

1. If the requesting State is unable to present any of the documents listed in Annexes 1 and 2 to the Agreement, the requested State shall interview the person to be readmitted in order to establish whether he/she possesses the nationality of the requested State.

2. The requested State may interview the person to be readmitted by officials of the central competent authority, posted in its diplomatic mission or consular representation in the requesting State. Before the officials of the central competent authority of the requested State take up their functions or in their absence, the officials of the diplomatic mission or consular representation of the requested State shall be in charge of the interview.

3. The central competent authority of the requested State shall inform the central competent authority of the requesting State of the results of the interview in the shortest possible time period and within a time limit of maximum 10 working days. In such a case, the time limits provided for in paragraph 2 of Article 12 of the Agreement begin to run from the date of the receipt by the requesting State of such notification.

Article 6

Readmission and transit procedures

1. For readmission and transit the Parties identify the following border crossing points:

a) for the Russian Federation: all international airports on the territory of the Russian Federation.

b) for the Swiss Confederation: international airports of Zurich-Kloten and Geneva-Cointrin.

2. The Parties shall immediately inform each other through diplomatic channels of any change in the list of the border crossing points provided in paragraph 1 of this Article.

3. The date, time and place of readmission or transit shall be established on a case-by-case basis by mutual consent between the competent authorities.

Article 7

Transit Application

1. The transit application shall be sent by the central competent authority of the requesting State directly to the central competent authority of the requested State by mail.

2. The reply to the transit application shall be provided to the central competent authority of the requesting State directly by the central competent authority of the requested State within the shortest terms possible by mail.

3. For the transit application a form is to be used which corresponds to Annex 2 of this Implementing Protocol.

Article 8

Escorting of a Person to be Readmitted or Transferred

1. If a person in the process of readmission or transit is to be accompanied by escorts, the requesting Party shall give the following information: First names, family names, ranks, positions and subordination of escorting persons, type, number and date of issue of passports and service identification cards, contents of their mission order.

This information shall be specified in paragraph «D» of a readmission application and/or transit application.

2. Escorts shall be obliged to comply with the legislation of the requested State.

3. Escorts shall not bear weapons and other objects restricted on the territory of the requested State.

4. Escorts shall be in plain clothes, carry valid passports and service identification cards, as well as mission orders issued by the competent authority of the requesting State.

5. The number of escorts shall be agreed upon in advance by the competent authorities on a case-by-case basis.

6. The competent authorities shall cooperate with one another on all issues related to the stay of escorts in the territory of the requested State. If necessary, the competent authorities of the requested State shall provide the escorts with possible assistance.

Article 9

Transmission of Data

The Parties shall take the required measures to secure the personal data subject to transmission.

Article 10

Costs

Costs incurred by the requested State in connection with readmission and transit which are to be borne by the requesting State in accordance with Article 17 of the Agreement shall be reimbursed by this State in Euro within 30 days upon submission of the evidence of costs.

Article 11

Language

1. For the purpose of carrying out the provisions of this Implementing Protocol, the documents listed in Article 4 of this Implementing Protocol, and Sections III and IV of the Agreement shall be drawn up:

for the Russian Federation — in the Russian language with translation into the English language appended;

for the Swiss Confederation — in the English language with translation into the Russian language appended.

2. Unless the Parties decide otherwise, the competent authorities of the Parties shall, when implementing this Implementing Protocol, communicate in English.

Article 12

Amendment and Addition

This Implementing Protocol may be subject to amendment and addition by mutual consent between the Parties.

Article 13

Annexes

Annexes 1 and 2 shall be an integral part of this Implementing Protocol.

Article 14

Entry into Force and Termination

1. This Implementing Protocol shall enter into force on the same day as the Agreement.

2. This Implementing Protocol shall be terminated at the same time as the Agreement.

Done in Bern on 21 of September 2009 in duplicate each in the Russian, German and English languages, all texts being equally authentic. In case of disagreement over the interpretation of this Implementing Protocol, the English version shall be used.
